The case concerns ground west off Krakow, near Wieckowice. According to Polish law the current starost of Krakow, Jozef Krzyworzeka, in 2000 the borough leader of Zabierzow, could take over 110 hectares of property near Zabierzow for free. The ground was designed for future highway and selling the ground to a future investor would allow the district for a large profit. However Krzyworzeka did nothing, even though local committees insisted on it. The ground was sold then in a tender to a private company, Polcon.Con for 1.7 million PLN.

To finish the highway investment the ground has to be bought back. The minimum for completing the highway is 20 hectares, and specialist say that for only that piece of land the state would have to pay 4 million PLN! What is more, Polcon. Con. has launched an application procedure to convert the area from farming land category into a building area, which, if successful, will inflate its value even more.

Krakow Business Park

Jozef Krzyworzeka has known the owner of Polcon.Con, Adam S. for many years. As a borough leader of Zabierzow district, Krzyworzeka supported the sale of ground in Rzaska, near Zabierzow, to Adam S., where later S. built Krakow Business Park complex. At that time there was another investor who offered a higher price for the ground in Rzaska, but this offer was rejected. To gain public support for Adam S. Krzyworzeka promised to donate 70% of the sale money to a school in Rzaska, but nobody knows what the sum was and has ever seen one brick being built there.

At present moment the prosecution accuses Krzyworzeka of filing a false tax return and not including in it 21,000 PLN earned in 2006 for working in Creation, a daughter company of Krakow Business Park that was issuing false invoices for fictitious services.

Krzyworzeka himself claims that not reporting the income was merely accidental and that he is not guilty of any aother charges. He has suspended his membership in Platforma Obywatelska party. Krzyworzeka's connections with Adam S., currently suspected for defrauding several million euros from Krakow Business Park, are under investigation.
